A Brazilian court has ordered the city of São Paulo to pay $2 million to the state of São Paulo to settle a lawsuit filed by a former Brazilian attorney general over the government's allegedly misleading disclosure of the country's best-selling drug, Viagra, to doctors and patients.
Judge Xue Hong-Yi, who is also a partner in the law firm of São Paulo, ruled in favour of the Brazilian government and against the lawsuit by São Paulo's attorney general, who was found to be in violation of the law.
The lawsuit was filed in a federal court in Sao Paulo, Brazil, in December 2017.
The lawsuit, filed by a former attorney general, accused him of "deliberate indifference" to public health by concealing the drug in the public domain. The Brazilian government said it believed the drug was not made available to doctors.
A jury later found that the government had "engaged in a deliberate and illegal scheme in the belief that its use would be exaggerated and potentially harmful to public health."
In a statement, São Paulo lawyer Paulo Roberto Júnior said: "This case is the result of a deliberate and illegal scheme to mislead doctors to provide the lowest effective treatment for patients and to harm them.
"The Brazilian Federal Court has issued a nationwide order to the Supreme Court to prohibit all doctors and patients from prescribing Viagra and to institute penalties to those who fail to comply with the order.
"This case has implications for the country's health care system and the state's public health system."
Júnior added that the decision "will be the first time the Supreme Court has issued a criminal judgment against an individual for taking a criminal act."
The Federal Court of Justice has also asked the government to restore Viagra's status to the country's health care system.

On 14 March 2023, the UK Medicines regulator approved an application to reclassify the erectile dysfunction medication Cialis. When marketed asCialis Together(tadalafil 10mg), it will be a ‘P’ (pharmacy) medication, and so available ‘over the counter’ in pharmacies – see. This follows the 2018, ‘P’ classification of (sildenafil 50mg) which has been available OTC, without a prescription, since then.

Unfortunately, there is a strong black market in the UK for ED medicines, which are often unlicensed or counterfeit. UK Border Force and the MHRA seize millions of pounds of these fake products from criminals annually. This new classification of tadalafil 10mg will enable men who suffer from ED to obtain it safely from a local pharmacy.
Sanofi, the drug manufacturer, is expected to launch Cialis Together later in 2023. Cialis Together will be available to purchase in pharmacies without a prescription by men over 18 with erectile dysfunction. Cialis Together tablets will contain 10mg tadalafil and the maximum pack size will be 8 tablets. Other doses and pack sizes of Cialis and tadalafil will still be available on prescription through doctors and specially trained pharmacists.
